Am I eligible for applying for ILR

I have been in the UK from December 15, 2010.

The expiry date of my initial 2 year Tier 1 General Visa is December 15, 2012.

I applied for extension on Nov 5, 2012 thru postal application. I was given an extension of 3 years (i.e Valid from February 5, 2013 to January 23, 2016).

If you look at the dates, from December 16, 2012 to February 5, 2013 I was staying in the UK without any visa waiting for the decision to be made by UKBA. So based on the above scenario, can anyone please help me with the questions below.

1. Am I a visa over stayer (Considering the fact that I have applied for the visa extension before it's expiry, it's the UKBA that delayed the decision on my application)
2. Am I eligible for applying for ILR on January 20, 2016 (Can the period between December 16, 2012 to February 5, 2013 be counted towards Continuous residence requirement of ILR)

I am in the UK from December 15, 2010. So I think until December 15 2015 the requirement of continuous residence(for 5 Years) for ILR is not met. Having said that, what made you say, I can apply for ILR between Tuesday, 17 November 2015 and Friday, 22 January 2016? Can you please clarify.

You may apply for ILR up to 28 days before you complete your qualifying period.

Anyone can give me home office customer service telephone number. I need to check the status of my application. It was refused and appeal granted in Nov 2014. I need to know how long it will take more. Initially I applied ILR in Jan 2013.
