Hi,

Someone can please explain me this FAQ.
"An important requirement you should pay attention to is that you need to have been physically present in the UK at the beginning of the 3/5 years residence period i.e. the day the HO receives your application 3/5 years back. This is a pass/fail test and the HO has no discretion with this requirement. "

My friend got PR in 20-Dec-2013 on basis of 5 years-work permit route.
He was on vacation on 27 Dec -2009 to 4-Feb-2010

Can he apply as of today, if not then when he should apply ?

he can apply on 3rd of feb. HO shouldn't receive his before 4th else it will not meet the requirement.

Actually he booked NCS service for today and going there :(

They said him , Theycan hold his application until he meets this date..
I am still not sure how they can hold it if the application fee will be taken today ?

What would be his best option ?
Loose NCS fee or can they reschedule the appointment in 2-3 week time ?

NCS will only take their fee not the application fee.
They can hold the application until the time but I have seen an application being sent early by NCS on this forum.

The NCS I have used, they always check these things before they give the appointment. He shouldn't be given an appointment.
He can still apply today if he trusts NCS will not post the application early.
