Hi, My daughter was born in the UK in 2011. I was on Tier 1 at that time and I applied a dependant visa for my daughter.
I got my ILR approved in June 2013 but did not apply for my daughter at that time.
Now, I am applying for naturalisation under MN1 form for her. The tier 1 dependant Visa for my daughter expired
in June 2014. Will this be considered as overstaying or as she was born in the UK, is it alright to apply for BC even with this
situation. Any advice will be highly appreciated. Thanks

As your child was born in the UK, she should be entitled to registration using Form MN under Section 1(3).

Technically speaking she is an overstayer but she is also "entitled" to be registered as a British Citizen under section 1(3) therefore being an overstayer will not come into question and should not create a problem.
