Tier 2 ICT to Tier 2 General to ILR?

Dear All

I have completed my UK assignment and am back in India. I have couple questions:

1. Am I eligible to apply for Tier 2 General visa without cooling off period?

2. Can I apply for ILR after 5 years if I re-enter UK on a Tier 2 General visa?

My immigration history is given below. Please help.

Tier 2 ICT Established Staff
Visa validity: Feb 2011 to May 2013
First entered UK in Mar 2011.

Tier 2 ICT Long Term
Visa validity: May 2013 to Mar 2014

Tier 2 ICT Long Term
Visa validity: Mar 2014 to Feb 2015

Hi,
Please could you clarify on the cooling off period? I am confused because, the Tier 2 General policy guidance document says cooling off period is not applicable for Tier 2 ICT Established Staff who entered UK before 6 April 2011. Here is the link to the guidance document. In this, please refer to page 7 for the rules for switching into Tier 2 General. Please could you confirm if cooling off period is applicable in my case?

Since you are back to your home country, you will have to apply for a Tier 2 General entry clearance. In this case, cool-off period will be applicable. The quote you mentioned is for those who are switching to Tier 2 General from within UK.
