Citizenship and Traffic Offence (PCN)

Post by jma75 » Sat Feb 28, 2015 12:25 pm

Dear Seniors espcially Amber,
I am a silent member of this board, it helped me a lot in past for all immigration applications, which were successful without any problem.
I have couple of question regarding naturalization which me and my spouse are going to apply in a week time.
1- Duration of stay should be total 5 years (including 1year ILR) for citizenship in case of spouse or more. As my spouse joined me few months later and has our 5 year stay in UK but less than 6 years.

2- I have only one PCN in last twelve months (for stopping in yellow box). I appealed in council against the fine but first informal appeal was rejected by council and was given a right to appeal in PATAS or pay the fine. I paid the fine. Will it effect my application process regarding good character (appeal against PCN to council). What I should write in page 15. Just only PCN and its number or full details.

Looking forward to your reply,
regards
JMA

One PCN should not affect your application.
I am sometimes wrong.

Dear Milan and esmi,
Thanks for reply,
It means I do not need to worry about PCN and appeal against PCN in council will not affect citizenship application.
I like to be sure, please can you also let me know about the other question as well.

PCN is not FPN and as long as you have paid the you are fine.
And even if you have just one FPN you are fine.
As far as your first question is concerned you have to be a resident in the UK for the last 5 years and hold ILR for one year. You are allowed 450 days of absences in total and 90 days in the final year.

Dear Advisors,
I am going to apply for my ILR after 6th May. Today on 28th March in the morning I was stopped by police for receiving mobile call whilst driving and fined 100 pounds and 3 points. I am very much worried about how is it going to affect my ILR application. Need your valuable advice please.

Driving while using a mobile phone is a serious offence and your application will be refused if applied before 3 years of the date of contravention

Dear Manka,
My 5 year tier-1 visa will expire on May 2016. What can I do now? Can I even not apply for ILR? Please advise me.

Sorry, I thought you were already on ILR as you posted this in citizenship section. You will have to declare this offence, there are many people who got ILR with his type of offence

You can apply for ILR when you are eligible, FPN won't effect your application unless you received it through the court.

if you received it through the court you have to wait 3 years
Applied: 11/03/2015
Approval: 04-04-2015 Dated 27/03/2015

If I don't get the FPN through court, do I need to mention in the application?

I initial entered UK with Tier 2 ( General ) Visa which was valid from 24-May-2010 to 22-Apr-2013 and my first date of entry into the UK was on 04-June-2010 which was 10 days from visa validity.
After one year, I switched over to TIER 1 (General) visa from 20-May-2011 which is valid unti 20-May-2016

What documents do I need to submit for this switch over for Tier2 to Tier1 Visa?

Do I need to submit any documents at all or not as my 5 year residence is the combination of Tier 2 (initial 1year) and subsequent Tier1 for 4 years?

Hi
This forum is very helpful for discussion and get advice from members.
I am due to apply for citizenship. I have 3 points TS10 (traffic signal) offence on Dec 2011. I accepted, did not go to courts. I checked online licence status, showing 0 points but still have offence (TS10). In April 2015, I renewed my licence for photo ID, still have 3 points on counterpart, confusing me. Please advice/suggest me on these following question.

1. Is unspent period over?
2. Will it effect my AN application?
3. Is it better to wait till Dec 2015 to get rid off offence from licence?

Regards
