10 year long Residency eligibility question

Quastion is whether it is worth applying under 10 years rule or not?

Situation is as follows:

Entry in the UK on family visit visa April 2005
Exit UK in august 2005

Then applied for student visa back home

Got visa in janyary 2006
Enter Uk on student dependent in March 2006

Break between departure from UK( visit visa) & Uk student visa stamp date= 167 days ( That is within the limit it is permitted in 10 years rule).

Break between departure from UK( visit visa) & UK entry date on student visa= 232 days


Reason of not able to travel within 180 days is that he got ill. He does have medical reports, doctor letter, family statements and ticket booking which was later cancelled because of her not able to travel due to sickness and also letter from travel agency saying that we booked a ticket which was later cancelled.

Since enter on student visa, applicant never left the country even for a single day.

U need to send them all the proves with set lr application. But keep in mind if your gap is is more than 180 days than its upon caseworker discretion to issue u ILR.

In the current political atmosphere when immigration is a key topic and HO is very strict, your chances r very slim to get an ILR
