Few questions regarding Natrualization

Post by solospy » Mon Mar 23, 2015 3:58 pm

Background

I am a British Citizen. My wife came to UK as my spouse on 1/12/2012 on a 27 months visa. She successfully obtained her ILR and received her BRP with the ILR date of 4/11/2014. She then flown out of the country on 16/11/2014 for Holidays and came back on 6/1/2015.

Questions

1. Am i right in saying that she can apply for her naturalization on or after 5/12/2015 ?
2. I know there is a requirement that she need to be in the UK 3 years before home office receive her application but is there any requirement of being in the UK 1 year before ?(Asking because she was out of the country from 16/11/2014 to 6/1/2015
3. Am i right in saying that if she apply through NCS she can travel outside teh country while her naturalization application is in progress ?[/list]

Thanks

She can apply any day after 1/12/2015 since here 3 years period will be completed.

She also does not have to be in UK exactly 12 months before the application.

No.

Yes. But personally I'd not recommend it till attendance of Ceremony.

As a British spouse the rule is u will be here for at least 3 years. The rule which says u should be on ILR for last 1 year is for others who are applying on 5 year residence category

Thanks for the confirmation SSWSZ.

Another question please and this time it will be stupid one as i want to apply my wife's naturalisation as early as possible after qualifying period. She landed in the UK on 01/12/2012 as my spouse. So she will complete her 3 years on 30/11/2015. Would it be safe to make an appointment at NCS on saturday 28/11/2015 ? I guess the earliest Home office can receive the application is on Monday 30/11/2015 isn't ? Is it safe to do so ?

Yes. From this link which says:
If married to a BC, you can apply the same day you are granted ILR if you meet the spouse requirements which includes 3 years residence. Any legal stay in the UK counts.
Please go through that link where seniors have compiled good information.
