Driving Offence – ILR Rejected

Post by zpoint » Tue Mar 24, 2015 5:44 pm

Please can someone advise me on my concern?

January 2015: I was stopped for driving without driving license. And the police cited reckless driving

March 2015: I applied for ILR for myself and wife (dependent)

Application denied because the Home Office said there is a record of me on the police system “pending conviction”

Please note Police has not informed me of any intention to convict me. They have not sent any communication to that effect

Home office did not return my passport and my wife’s passport

Please can you advise on the way forward? I can only assume the reason is not valid because intention to convict me has not be communicated

What can I do at this stage?

You should have a right of appeal.

Were you given a right of appeal?
