ILR 10 Year Query

Post by EJ PERTERS » Fri Apr 03, 2015 5:55 pm

Hi Amber

Hello, Greetings to you who have made this forum so informative.

I believe my application should be straight forward but which to get an advice as in intend to apply next week.

(1) Firstly,
I first arrived in the Uk as a visitor , 1st of April 2005 stayed in UK for 3 weeks then returned back to my own country and returned back in to the UK June 15th 2005 ( spending about 75days out) on a student visa and has never left the country since then till date.

Questions 1... Does my entry as a visitor count in my 10 years or I have to wait till June 15th to make my ILR application.

(2) Secondly,

I am currently on a point base dependant visa with 10years stay made up of shown below
1. Visiting visa-----------------April 2005
2. Study Visa-------------------June 2005 - Jan 2012
3. PSW-------------------------- Feb 2012 - Feb 2014
4. Student dependant-------- April 2014 till Dec 2018

Question 2. Since April 2015 will make it 10years in the country , am I entitled to apply for ILR and if so what form am I to use.

Kindly advice as I look forward to making an application ASAP.

Many Thanks

Yes time as a visitor will count. SET(LR) is the form. KoLL required. From 28 days before April 2015.

Thanks CR001 & Amber,

As indicated on my details. Am currently on PSW dependent visa to my partner who is a student. And we have 2 kids born in UK. 6 years 5 months and the other 9 months old.

Although my partner visa expires 2018 ....can I apply for all to be my dependant along my application or after mine is successful.

Kindly advice

after mine is successful
If your dependants switch to FLR(M) as your dependants, it will reset the qualifying time to zero and they will need to wait a further 5 years for ILR. You will need to meet the financial requirement and pay the NHS surcharge of £200 per year £500 for 2.5 years spouse visa) and this is payable upfront at point of application.

Your UK born children can be registered as British once you get ILR.

Should switch to FLR(M), it will be a new 5 year route to ILR (unless your partner reaches 10 years residence sooner).

Financial requirement has to be met £18,600, this will increase if your children are not British yet.

NHS surcharge will need to be paid for yoyr partner (£200pa x 2.5years Flr(m) visa = £500).

My Partner is due to reach 10 years in January 2017.

But there is a gap of outside the country trip he had in 2013 .

He travel out of the country on 1st April 2013 and returned bad 5th October 2013.

On this ground we are worried if he still qualifies for the long residence route , if not whats the best option

Many Thanks for your swift responces
