Tier2 Sponsore Guid clarification

Post by UKkumar » Thu Apr 09, 2015 4:53 pm

Hi Seniors,

Could you please clarify below paragraph of Tier2 sponsor guideline?

5.6 If you are an employment agency or employment business, you can apply for a sponsor licence but only to sponsor migrant workers who will be directly employed by you in connection with the running of your business. You can’t sponsor a migrant who
you then supply to a third party as labour, regardless of any contractual arrangement between the parties involve.

Does it mean that sponsor cannot send their employee to take contractual work?

Thanks

as per the text you quoted this only applies if the sponsor is an employment agency (umbrella company)

Thanks

Thanks Manci,
How about Limited Company? A limited company who sponsor migrant workers to supply to another company to work on contract basis.

lots of people doing it doesnt make it legal.
A company cannot source a person to another company while they are sponsored under the tier 2.

Thank for your response. More details do you have any documents link to refer this restriction. I am so confuse whether it is legal or illegal.
I seen lot of advertisement which says if some one have contract offer which pay £XXX/day, he/she can get Tier2 sponsorship visa. For example in this website (immigrationboards.com) itself advertise for such sponsorship help.

Guru please i need your valuable advice.
