PBS (Tier 1) dependent extension query

Hi All,

Help needed...

I am eligible for ILR in Sep 2015 via Tier 1 General 5 year route, but my wife is not eligible till Jan 2018 as she came to UK in Jan 2013 as Tier 1 dependent.

When we last renewed our visa's we got the extension till Feb 2017 ( 3 years ).

My questions is when I apply for ILR in Sep 2015, will my wife have to apply the dependent visa again and spend £1800 for visa and £600 for NHS surcharge, inspite having the validity till Feb 2017 ? or she can wait till expiry of the current Tier 1 dependent visa and renew it Jan/Feb2017 ?

I am asking this questions because as per the current immigration rules, she cannot switch her visa to "Family of Settled Person" but will still have to renew it as PBS dependent.

Of course she can switch to spouse of settlement visa, it is your choice. However it will reset her ILR clock to zero and she will have to wait a further 5 years in that category before she can apply for ILR. It also includes 1 extension as it is initially a 2.5 year visa. NHS surcharge payable for initial application and extension.

She would be better waiting as Tier 1 dependent in my opinion.

She would only need one extension as a pbs dep whereas if she switches to FLR(M) it is the cost of the initial switch and another extension after 2.5 years.

She should renew her existing visa before it expires in 2017 and then once she reaches almost 5 years residence, apply for ILR.

My wife has the same situation

My ILR (husband) is due next month and my wife is on PBS Dependent, first visa which was for 9 months will expire in Sep 2016.

Could you please let me know
1. what will be the best time to apply
2. which form she has to fill
3. and will she give NHS surcharge fees too?

2. which form she has to fill PBS Dep or FLR(M), whichever you choose to do.
3. and will she give NHS surcharge fees too? Yes, payable for whichever one you choose. She is not exempt.
