Dependent ILR

Post by 121669gvk » Mon May 11, 2015 11:24 am

Hello Advisers ,

My friend who eligible for ILR as on 20 Jan 2016 who came to UK 5 years before under Tier 1 general.

His wife was in Tier 2 ICT ,came to UK 26 Jan 2011 and left UK May 2012. Entered UK with new entry clearance as dependent of main applicant on 24 Nov 2012 ( Entry Clearance of Tier Dependent 17 Sept 2012).

Questions:
1.Will his wife be eligible for ILR along with main applicant while submitting together on 20 Jan 2016?
2. If not , when she will be eligible)
3. Is it 2 years resident requirement or 5 years resident requirement?
4 Does period spent on Tier 2 ICT does count towards ILR?

Appreciate your response.

2. If not , when she will be eligible) Only in 2017
3. Is it 2 years resident requirement or 5 years resident requirement? 5 years
4 Does period spent on Tier 2 ICT does count towards ILR? No, not if she was on her own Tier 2 ICT. She will need 5 years residence as PBS Dep to qualify for ILR. The time on Tier 2 ICT can only be combined for ILR based on 10 years long residence

Hi there

If my partner has 5 years residence as PBS T2 general dependant, and I switch from T2 general to ILR via 10yr route in a few years time; Is my partner qualified for ILR after I get mine ? If not what options do we have ?

Many thanks.

Hi All,

I got ILR granted in Nov 2014, My Spouse(PBS Dependant visa Valid
till 2017) was outside UK from Sep 2014(Due to medical & child care
issues). Now I am planning to bring my spouse to UK next month( June
2015.)
Spouse PBS Dependant Visa was first granted in July 2010.(She falls
under before July 2012 rule)

I wanted to know, is there any limitation on duration of stay
outside UK for PBS dependants making their visa inactive?

Can I bring them in next month (June 2015)

Yours faithfully,

Swamy Asha
