Permanent Residence after WRS

Post by evalyn2401 » Thu May 28, 2015 10:57 am

Hello all,

I have come to live in the UK from one of the EEA country in April 2010. I have been a jobseeker (not registered at the JobCentre) and have proofs of applications for jobs. I have been offered a position in the NHS in June 2010, but the start date+WRS issue date is October 2010.
My question is, am I eligible to apply for a PR now(June 2015), seeing as I was jobseeker at that time 5 years ago, or do I have to wait until October?

Also, the WRS scheme was scrapped in April 2011, so how does that relate to my residency period of 5 years?

Many thanks
Eva

You should be able to use the period June-October/2010 as a job-seeker as long as you prove that were actively looking for a job, ex. rejection letters. However I'm not 100% sure about this, see below for details of who to contact about that.

Regarding WRS.
If you started your employment before WRS was abolished, that is between 2004 - June/2011, you need to show that you have met WRS requirement.
In your case, you need to show WRS for the period of October/2010-June/2011.
Also, you need to check the date you started your employment on your WRS certificate and the date the certificate was issued. The requirement was to apply for WRS withing 30 days of the start of employment. If you failed to do so, your qualifying period starts on the date WRS was issued.
For more details take a look at this document

I would suggest you contacting AIRE Centre, to confirm if job seeking is counted towards qualifying period.
The AIRE Centre is a specialist law centre providing free legal advice on European law issues, including EU law on the free movement of persons. If you have a query about an individual case, the best way to get in touch is by email: info@airecentre.org
