I'm on WP in UK where my Gross earning on salary slip reflect allownace majorly which is not taxed does this is accountable in Gross earnings for eligibility criteria for HSMP.

Allowance will be considered as valid only if they are declared in the payslip.

Going by this, I guess you allowance will be considered. However I am not convinced that the entire allowance is not taxed.

Have you received your P60 for the last financial year? If yes, then what does that reflect?

Has your employer given you any tax credit which you can claim from the HMRC ?

Yes I got P60.but P60 refelects only salary from India and some part of allowances also being taxed
but salary slip shows allowance.
yes ..I can claim back my Tax from HMRC .....always

If you have your P60, and then if that definitely reflect your taxed income, then how can you say that your allowance isn't taxed?

the slip statement reflects ...2 parts
1)salary 2) allowances
Salary is 757 and allowances are 2200. out which salary is taxed but allowances are taxed very less hardly 10 %

I can understand case. I guess this is one of those onShore-Offshoring business model carried out by most companies in India.

Correct me if I am wrong :
These companies pay a daily allowance in UK. You must also be getting your either basic or entire salary in India.

I can also understand the 2 parts in your payslip. i.e. Salary and allowances.


What I cant understand is how are/can they showing your Indian Salary in a UK Pay slip? I am not sure whether that is legal or not.

Going purely by your payslip, your case is absolutely valid. It doesn't matter to the HO whether you receive your payments as allowance or salary or both. As long as they are reflected in your pay slip it is absolutely fine (Sr. Members please comment)

I guess you will also have to explain your case in detail in the cover letter to the HO. (Sr members please comment)
