Kid born abroad when parent apply for Citizenship?

Post by rahulm.creative » Fri Jun 05, 2015 10:21 am

Hello,

Myself and wife got ILR granted yesterday, but we didn't apply ILR for our Kid (Born In India) as PBS Dependent Visa is valid till March 2017. Next year June 2016 we will be eligible for Citizenship, hence can we add our kid at the same time? OR we need to apply for ILR first before adding her in the citizenship process?

Thank you!

It's risky to apply without ILR.

I believe ILR is generally required for children born outside of UK because his citizenship application will be under section 3(1) which is a discretion and not an entitlement. Seniors might be able to tell you better.
It would have been a lot simpler to have included him in your ILR application.
