Help filling SET(M) for my wife's ILR

Post by kumar_15 » Tue Jun 16, 2015 7:14 pm

Appreciate if you could help me filling SET(M) form for my Wife:

2.10 How often do you see (meet) your partner?
I have mentioned "Everyday", I hope this is right ?

2.11 When did you last see your partner?
I have mentioned "Today", I hope this is right ?

2.27 Do you or your partner have any shared financial responsibilities?
I am paying the house rent and all other expenses, she is not working. I have mentioned "No", I hope this is right ?

Thanks,
Kumar

Yes to all three and for 2.27 you could explain in the relevant space towards the back of the form.

It appears you obtained ILR based on Tier 1.

Why is she applying on Set(M)
What is your wife's current visa status?
How long has she lived in the UK?
What is her visa/immigration history?
Why is she applying on Set(M)

Hi CR 001,

Thanks for confirming. Yes I already have PR, me and my wife were suppose to apply for PR together but due to medical reasons she is still in India and will be coming to UK in the month of July. We both were living together and she has already lived with me for more than 2 years in UK. Below are the answers to your questions:

Why is she applying on Set(M)
- She has already stayed with me for more than 2 years in UK and now eligible for ILR, hope I am right ?
What is your wife's current visa status?
- She has Tier 1 Dependent Visa
How long has she lived in the UK?
- She has lived with me for more than 2 years and then went back to India for medical reasons.
What is her visa/immigration history?
- Her first visa was on 26-April-2011.
Why is she applying on Set(M)
- Then which form do I need to fill in ? The gov.co.,uk says SET(O) and SET(M), I used SET(O) for myself and I am assuming SET(M) should be used for dependents who wants to apply for ILR !

Please let me know if something is wrong here ?

How long has she been out of the UK now?

When does her current visa expire?

When is she planning to submit her ILR application?

She cannot use Set(M) as she does not have leave to remain as a spouse of a person settled/BC. She needs to complete Set(O) as a PBS Dependent for ILR.

Hi Char,

Thanks a million for the clarification, below are the responses to your queries:

How long has she been out of the UK now?
- She is out of UK for about one year and six month

When does her current visa expire?
- Her visa is valid till 28-Oct-2016

When is she planning to submit her ILR application?
- I have booked the date for 20th of July for premium service.

She cannot use Set(M) as she does not have leave to remain as a spouse of a person settled/BC. She needs to complete Set(O) as a PBS Dependent for ILR.
- Thanks for this clarification, in SET(O) form there are fields for the main applicants as well ? Should I leave them empty because this will only be for my wife ?

Thanks,
Kumar

For Set (O) you complete it as if she was the main applicant. When is she coming back to the UK?

What cohabitation evidence do you have given that she has now been out of the UK for 18 months and obviously has not been residing in the UK during the last 2 years?

I would avoid submitting her application in person and suggest you apply by post. Premium Service Centres can only deal with 100% straightforward applications and anything that needs a decision by a senior level caseworker will not be processed on the day. It would then join the postal queue at the premium fee.

Thanks guys for helping me.

She is coming back in mid of July, below are the proof we have:

I am not sure if staying outside UK for 18 months is a big issue but I haven't found any strict rule regarding this.

We have below bills:
- Council Tax Bills on our names
- I have to request for Electoral letter, which I will do it in this week.
- Bank Statement on her name since 2011
- NHS letters on her name since 2011
- My bank statements
- Electricity and water bill on my name

Hope this should be sufficient!

I might be required to travel on business trip through my office so applying via post is bit difficult, I will need my BRP/Passport.

Thanks
Kumar

I need your feedback please , I am filling up SET(O) form for my wife who is on Tier1 General Migrant Dependent visa for ILR.

Below section I am not sure if they are right:

Section 3 - Which category?
PBS dependant

Section 12 - Documents
12A All applicants
I have checked below options:
Passport, BRP, and Marriage Details (cohabitation proof documents) but it says dependents in section 2 and there is nothing filled in ection 2 because my wife is the main applicant.

Hope I am right !?
Thanks in advance.
