Hello

looking for help I am planning in getting married next year and then apply for the spouse visa. Does this affect us now about the 35000 pound requirement for ilr?

It does seem reasonably likely that they will introduce a minimum earnings threshold for Family route Settlement at some stage, given the current government's form in other areas of immigration, but given that people applying under the new (2012) FLR M route won't be eligible for Settlement until 2017, there is no rush for them to announce such a thing. In short - not at the moment, but always expect the rules to change. They love pulling the rug from underneath us!

Hi thanks for your reply. So just to clarify if I am doing my husband spouse visa then Ilr after this 35,000 requirement wont affect spouse visas.

There is already a minimum earnings threshold. It is £18,600 and more if there are children. This was introduced in July 2012 and this financial requirement has to be met at each stage of the process (2 x visas and ILR).

As far as I can see, they haven't yet produced a SET (M) for for those of us who applied under the new rules introduced in 2012 - The current SET (M) guidance form specifically states that it is *not* for people applying under the new 5 year route, so the exact requirements for the ILR part of our journey have not been announced yet? It makes sense that it should be 18,600 the same as the FLR application, but I haven't seen any cast iron guarantee that the requirements won't be made more stringent before the first cohort of people applying under the new 5 year route reach the stage where they are applying for settlement?

If HO makes changes, it is unlikely to affect those already on spouse visas and enroute to ILR. It is likely to only be applicable to new applications after any changes are introduced.

Yes, apologies, I take it back. I've just re-read Appendix FM, and there are actually no income thresholds mentioned at all for ILR. The applicant must just "have completed a continuous period of at least 60 months with limited leave as a partner under paragraph R-LTRP.1.1.(a) to (c)" and pass the life in the UK test.

I have got into the habit of being rather pessimistic when it comes to the current gvmt and immigration law!

No it won't. The income level remains at £18,600 per annum for spouse settlement.

Don't believe everything your 'hear' from 'friends'. Nothing has been published about increasing the threshold and it is still £18,600pa for spouse (more if there are non British children).
