Employee ---> Self-Employed

Post by ILR2015 » Mon Jun 22, 2015 9:45 pm

I am Indian citizen with ILR (based on T1G). I will be eligible to apply for naturalisation in Jan 2016.

Currently I am an employee, but I am thinking of resigning and becoming a self employed. I will be employee for another 3 months, i.e. until Sep2015. After that, I will register as self-employed, which will take some time.

1) On the day of sending AN form in Jan2016, I will be self-employed, so I will tick 'self-employed'. Form says that self-employed applicants need to submit HMRC self-assessment statement of account. How can I show HMRC statement in Jan2016 when I will be on PAYE till Sep2015?

2) Do self-employed person need to fill Q1.52 'Address of tax office or tax office reference'?

Thanks,

1. You can provide invoices and bank statements as proof you're providing services and getting paid for it.

2. Probably not if you're a sole trader but if you're going to become a limited company then - yes.

Regarding Q1, I am not expecting any invoice in my first few months, as it will take some time to settle my new sole trader business, will that still be ok?

Being employed at the time of the application is not a requirement so you should be okay anyway.

It would have been so simpler if the form is amended to say 'if you have recently registered as self-employed then provide any other document showing your previous tax affairs'

You dont need to provide any P60's or self assessment returns if you are employed or self-employed. In both cases you just need to provide your tax reference number. Home Office can check from that reference number whether your tax affairs are in order or not.

You do not need to inform them. If they need any information from you - they will write to you.
