Applying for spouse visa. Do children need British passports

Post by James738 » Tue Jun 23, 2015 2:10 am

I am a British citizen married to an American woman. I'm about to apply for her to immigrate to the UK. We have two children, the younger of whom (a British citizen through me, but born in the U.S.) does not yet have a British passport. He only has an American passport. He will be moving here with my wife when she immigrates. Do I need to apply for a British passport for our child before we can send off for my wife's immigration. If we don't get him a British passport, will he be treated for immigration purposes as a non-British dependent of my wife? Thanks for your replies.

Yes your child would need a British passport otherwise you would have to evidence that you earn the equivalent approx 22K to cover your spouse and child rather than 18,600 just for your spouse.

Thanks for your response. We'll get our son a British passport then. I'm under disability rules for my wife's immigration, and so I am exempt from the income requirement. I still need to show what's referred to as "adequate maintenance" though.
