PBS Dependant - NHS Surcharge

Dear All,

I have some clarifications on NHS Surcharge for PBS Dependants.

My case history is below

I was on Tier 2 ICT and obtained ilr on 17th June 2015 (Premium appointment - Croydon). I applied for PBS dependant for my wife and its approved on the same day and we received our BRP cards on 19th June 2015.

I made both applications via solicitor. He said i need to pay nhs surcharge (£600) for PBS dependant application and as he had my card details he paid the money on 16th June 2015.

Ive gone through the IHS calculator now and i think my wife is exempt (PBS) from paying £600.(although i need an IHS reference number)

All gone through fine . IS there a way i can get refund for IHS which was paid unknowingly by my solicitor.

I guess my solicitor has selected the option 'Applying outside the UK' and then selected the option 'settlement' which leads to £600 to be paid. And this clearly shows solicitor's lack of knowledge on this.

Note: My wife was under Tier 2 ICT dependant before i applied for PBS dependant.

Any views on this is much appreciated.

All PBS dependents have to pay Health Surcharge.

That's incorrect (1(i), 1(c)). But it's unclear what happens to dependants when/after the main applicant was granted ILR.

Hi Manikandan,

Did you get answer to this?
Does IHS payment applicable to ILR dependants?
The OP's spouse is a Tier 2 ICT dependent and IHS is not payable as Tier 2 ICT and their dependents are exempt.

For applicants applying as ILR dependent on FLR(M), IHS is payable.
