MAC review of TIER 2 route

Hi folks, the dreaded MAC call for evidence in Tier 2 route review is out, considering -

1. Tier 2 to be applied to shortage occupations ONLY -- basically a possible end to Tier 2
2. Whether to apply NHS surcharge to Tier 2 ICT
3. Whether to restrict Tier 2 spouses and children from right to work

Maybe i missed something, judge for yourselves.

The time scale given in the mailing that went out, suggests that any possible changes will be in April 2016.

They are trying to make life for tier 2 and in affect u are right looks like they are trying to make it impossible to employ skilled workers from non eu ...
tough days are coming I hope we all sort over visas out without problems.

What's the point - even if we manage to extend for once, ILR is nothing but impossible if the new proposed changes are implemented. £50,000+ for experienced software professional - not even google can afford.

The bizarre salary increases are no longer an issue. As the minimum salary for ILR for Tier 2 is now fixed at £35K as of april 2016.

The rule is that you need to be paid on par with the minimum salary for SOC code at the time of applying. This means if for Eg SOC 2136
has been raised to 45000 GBP for experienced professionals you then need to earn 45k at the time of applying ILR.If you show 35k salary when applying for ILR it will be rejected.

The first stage report was supposed to come out yesterday, but the MAC website is still not updated until now.
Any idea what's happening?

On 22 July an inquiry into the Tier 2 Skilled Workers system is launched. Could this be a reason to hold the report?

Just a remark!!
No one said it'll be applied to shortage occupations ONLY, it is shortage occupation and HIGHLY SPECILAIZED EXPERTS, so the door is still open depending on what will be the definition of highly specialized experts?. Anyway I think it's bad and will be tight, but it's not completely hopeless, we will find out soon.

Hmm, increasing SOC to unreasonably high might be bad news for people like me who work as software engineer earning just over 33k. I will keep watching the news and update this thread.

I have been reading all of the news, and I suspect they going to increase or even limit the Tier 2 visa.

I am planning to get my extension this year even though it expires in July 2016 next year.

MAC posted update on review of salary thresholds.

One of the points mentioned was

The MAC’s initial analysis has found little evidence to suggest there is widespread
undercutting of UK resident workers by Tier 2 migrants occurring under the current
salary thresholds, though this finding is subject to further work being undertaken as
part of the wider review

I read it this morning as well, there statement is totally political.

On one side they are saying it doesn't effects on other they are suggesting to rise salary thresholds.

If you read the report carefully, impact of raising the salary to 75 percentile will be a big blow for current Tier 2 visa holders. Forget about getting ILR even getting an externsion after 3 years will be not possible for most of the Tier 2 holders. Still they might not raise it to that extent but it is always a possibility.

Thats true.

BUT after 2.5 years my 10 years will complete as well, so for me its best to get it now then later

MAC has kind of recommended for now against increasing the salary threshold.

My advise is to get it done as soon as possible. Doing it earlier would loose you nothing but doing it later has chances for disapproval in case rules changes....

When SOC will be updated for Tier 2 ?

MAC reviewed and suggested to add more 2136 roles like senior developers to to Short Occupation list in Feburary 2015

MAC may only recommend.
It is up to the government whether to accept any recommendation or not.

So the answer to your question is - only when the government decides to accept MAC recommendations (partially or wholly) and introduces the change(s) to immigration rules.

@Sushdmehta: firstly, thanks a lot for all the advice and support you have provided to all of us over the years. Your posts have helped me immensely.

This tier 2 policy update (in April 2016 ?) will be very decisive for a lot of tier-2 general immigrants in UK.

I am myself a dependent spouse and have refused taking up a separate CoS from my employer as my ILR clock will restart.

Lets hope for the best !!
