Switching from Tier 4 to Tier 2 after November

Greetings all,

I was just curious as to whether this restriction published by the home office that says that from November (I've seen 12 November.), those under a Tier 4 will not be able to apply for a Tier 2 within country.

Would this apply to anyone on a 1-year master's whose results won't be released until November? Does this mean that the Tier 4 holder must exit the UK, and apply for a restricted CoS requiring the employer to do a resident market labour test?

Any advice would be most appreciated!

This is for college student, not uni student (bachelor, master, PhD)

I have a question concerning it effective date. It comes into effective date since 12.Nov.2015, so basically it applies to those whose T4 visa issued after 12.11.2015, or it will affect all current T4 holders?

Scroll to page 36. The rules about working rights only apply to adult further education, or colleges. This would be schooling to prepare for entry into university for example. This is different from universities, which is for Bachelors and Masters degrees.

For the effect date, they would apply to all current Tier 4 then and to applications to extend/switch made after the date.

So just to clarify, once a master's student (currently holding a Tier 4) receives his/her certificate and has an offer of employment, she can apply for a Tier 2 within the country (i.e. requiring an unrestricted CoS)?

I mean where I can find the information that all CURRENT T4 HOLDER are affected after November, or ony NEW ISSUING T4 HOLDER AFTER NOVEMBER ?
