Calc. continous period in UK for applying naturalisation

Post by SK78 » Sun Jul 26, 2015 4:21 pm

Dear Friends,
I got my ILR in Jan-2014. Then immediately I travelled abroad to my country and stayed there for 11 months
(Feb 4,2014 - Dec 13, 2014). Again I travelled back to UK on Dec 14-2014.

Please let me know if the below calculation of continuous period is correct if say I am applying on 01-Oct-2015.
Year 1 01-Oct-15 02-Oct-14 74 - < 90 days
Year 2 01-Oct-14 02-Oct-13 240
Year 3 01-Oct-13 02-Oct-12 0
Year 4 01-Oct-12 02-Oct-11 50
Year 5 01-Oct-11 02-Oct-10 0

Basically I am splitting the 11 months absence in last year into two absence (74 & 240). Is it fine if I am absence for < 90 days in the beginning of the calculation year (02-Oct-14 to 14-Dec-2014 = 74 days), so in effect, in last 12 months I was not away from UK for more than 90 days.

Thanks.

You may apply as and when you meet the standard requirements.
So, if your absences from UK are less than 90 in the 12 months preceding the application and less than 450 in the 5 years preceding the application, and you fulfill all other requirements, you may apply.

Make sure that you were physically present in the UK exactly 5 years ago on the date the HO receives your naturalisation application.

There's some quickfire editing going on in this topic but I get a sense the OP is intentionally deferring applying until October;
s/he is doing this so that when counting 12 months back (to Oct 2014) the absence is well under the 90 days that is usually permitted for the 'final' year before applying for naturalisation.
The remainder of their continuous 11 month absence will then fall into the preceding year.
