Tier 2 ILR Success with more than 180 days continuous break

Hi Everyone,

First of all, I want to thank everyone in this forum, who helped me.

I got my ILR on 21st July, 2015 through Tier 2 ICT route.

Entered UK in Jan 2010 on Tier 2 (ICT).

There was a continuous break of 218 days [11-May-2013 to 15-Dec-2013] which was split across 2 years.

My original case is under :

My Appt was 9.10 at Croydon PEO. I have not included my spouse as I wasn't too sure of the outcome.

PEO experience:

08:50 : Entry and Airport style security
08:55 : Case Precheck and Token no assigned
09:00 : Case registration
09:10 : Bio-metrics
09:30 : waiting consideration
10:00 : under consideration
10:30 : Ready for collection with approval letter.

I submitted following documents.
1. SET (O) Form
2. Passport + BRP Card
3. Life in UK Test certificate
4. Payslips – 12 Months
5. Bank Statements – 12 Months
6. P60 – 2010-11, 2011-12, 2012-13, 2013-14, 2014-15 (5 Years)
7. Employer Letter
8. Cover letter
9. 2 photos

I didn't submit any absence letter.

Hello SJ,

Congrats on your ilr.

During your work back in India, have you got UK salary?

I am on the similar situation and was issued p45 when my work was initially completed and came back to Uk on same visa. I am in dilemma to apply for ilr.

Additionally, did you have continuous valid visa? And did you ask your Indian company for the employer letter quoting ILR as the requirement or told them it is for something else: -)

No, I was paid in India.

Not sure about P45. My company issued P60.

Yes I had continuous visa. My employer didn't provide a letter with ILR as requirement. I asked for the bonafide letter (For applying visitor visa for my parents :) )

Can you please let me know when you arrive to UK first in 2010 ?
I am also in similar situation like I have arrived UK in August 2010 on Tier 2 ICT established staff visa and switched to tier 2 general visa and completing 5 years by next month. Can you please let me know am I eligible to apply ILR now ?

As far as I know, your 5 year period start from the date you switched to tier 2 general. As you came after 6th Apr, 2010, you can not apply for ILR on tier 2 ICT. Better check with someone else.

SJ30 is correct. Tier 2 ICT visas applied for after 6th April 2010 do not count for the purposes of ILR. So, only the time on T2(G) will count.

But
a) What counts is the date of application for the Tier 2 ICT visa, not its date of grant. Get your HR to go through its files and find out the date it was applied for and if possible, a copy of the application.

b) You can also apply for a SAR from the Home Office, which should indicate which day they got the application and their records of what they consider your date of application.
