ILR Eligibility - Much appreciated for replies....

Post by bkchow » Thu Aug 06, 2015 1:58 pm

Dear all

Thank you all for your replies - this is an information forum! I am here to seek a clarification to the 5 years continuous x absence criteria. Honey provided a good example with entry dates and ILR application. Please see below my case, followed by my assumptions, which I would like this forum to critique and comment.

Entry Clearance: 20-12-2010
Actual Entry: 13-02-2011 (Period of absence between entry clearance and actual entry is 54 days AND counted as absence)
Visa valid until: 05-02-2016

My assumptions:
1. I must include 54 days absence into my total 180 days in first 12 months of absence calculation (holidays were 13 days in this period)
2. I may apply for ILR within 28 days of reaching 5 years continuous stay, being from 24 Nov onwards (20-12-2015 minus 28 days = 24-11-2015)

I would appreciate your comments regarding the above 2 assumptions and provide clarifications - many thanks!

Time between entry clearance and entering if less then 90 days is not counted as absence.
