Child Born in UK to ILR parents

Post by jilpangs » Mon Aug 17, 2015 12:26 pm

Hi,

Me, My wife & 6 year old kid are ILR holders.

We just had another little one arrived few weeks back. Born in UK.

Questions are

a) Is it advisable to apply ILR for new born?
b) or apply for British Citizenship directly? We (me, my wife, elder one) haven't decided to go for British Citizenship yet but eventually might do it (after a year or so). so can we apply only for new born now ? and apply for citizenship for 3 of us later?
c) if we go with item b, then should we apply for OCI card for newborn to visit India? OR just a visa for one time whichever is quicker.
d) what would be timelines for items b&c? We are planning for India visit in Dec this year.

Apologies if these are basic questions. I couldnt find specific answer to these in Sticky notes.

Thanks for time & Patience.

Regards
JP

a) No.

b) Child is automatically British, if a parent has ILR when child was born.

Thanks Vinny.

Birtish URL states we can apply for Passport directly. Can we apply only for newborn while rest of us stay as ILR?

If yes, what is the form to be used for newborn (for passport)?

If child was born whilst parents hold ILR then child is British by birth and you can apply for their passport directly. Just grab passport form post office filled and attached relevant documents and post it. You can also apply online but you still need to post your documents. Passport fee for minor is £45 and valid for 5 years only.

In this case for newborn, can anyone clarify usual time taken to get British passport?

On top i need to apply for OCI so that new born can travel to india.

Can all these happen before Dec 2015 as we have planned for a india trip.

sooner you apply for it sooner you will get it.
now it may take longer than usually as kids are off school so more people apply.

You can apply using the 1 week fast track service, it costs a little bit more.

Thanks Guys.

Do we need to wait till we receive British Passport to apply for OCI?

What is the typical time taken for OCI card? any Fast track available for OCI too?

OCI-related questions probably sit better here (as not related to British Citizenship/jurisdiction):

Thanks everyone for the responses. Been away due to medical reasons.

We have now applied for British Passport for new born and waiting for it. Applied online and posted documents. Hopefully we will get it in next 2 weeks. I will keep you all posted.

Question now: Looks like OCI card might take 12 weeks or more. So i'm not going for that option now as we need to travel in Dec first week to India.

We need to take Indian Visa for new born. So what is the quickest option we got ? Visitor Visa? How long it will be valid? My family will be in India for an Year so the Visa needs to be Valid atleast for 1 year.

Please direct me to right forum / URLs. Many thanks.
