Home office appeal out of time

Hi

Me and my husband applied for Flr fp on the base of exceptional circumstances. We were refused but in appeal the judge allowed the appeal on the basis of human rights and Article 8. Home office has 14 days time to challange the decision they submitted application in court to get permission of appeal after the time has passed .they are 3 days late . Please tell me how much is the chance that the judge will grant them permission of appeal to Upper Tribunal and how much is the chance of our winning in Upper Tribunal .please please help me.

It depends on the judge and their reasons for the delay.Your barrister will advice your further.It will be difficult to tell you what chances you have of winning in the higher court as we are not familiar with your circumstances.

I hope the case doesn't go to the upper tribunal .Good luck with your appeal.

Thank you for your reply... i have heard if home office or any appallent submitt application for permission to upper Tribunal out of time then it becomes difficult to get permission for upper tribunal. Hope it doesnt go to upper tribunal. Can you tell me how long it takes to know that they have been granted the permission or not?
