All, appreciate insight, clarification and any expriences of this rather odd case

So Have been on a Tier-1 which I've been extending till now.

My Current Visa Expires on 15th Apr 16. And I would finish 5 years on 5 May 2016. So its less than 28 days.

Does this mean I can apply for ILR from 5th April 16 - 28 days before I complete 5 Yrs

or

Do I need to get another visa just to cover these 20 days?


Any one been in a similar situation?

Should be fine yes.
Do I need to get another visa just to cover these 20 days?
If you are Tier 1 General, this is not possible anymore as the route has been closed.

The earliest you can apply will be 7th April 2016, which will be 28 days before 5th May 2016 (check it in Excel).

As ILR fees tend to go up on 6th April every year, you will be paying the higher fees. Last year, it jumped from £1093 to £1500 overnight on 6th April. With the new Spending Review going on, there may be a similar hike next year. The new rates will be announced close to the end of February next year.

Can you confirm whether you entered the UK within 90 days of getting the original Tier 1 visa? The date on which your Tier 1 General visa started is either the date of visa grant, if you entered the UK within 90 days or the date of entry if more than 90 days.

Yes I entered within 90 days of original visa issue.

Looks like I can in fact apply 28 days before and not worry about finding someone who can sponsor a visa just to cover that brief 20 day period..

28 days grace period is from the date of VISA expiry, so you should speak to a solicitor, as you might need a VISA for 20 days

What date was your original entry clearance issued on which you entered within 90 days?
