Dear Members,

I have submitted an online application for Tier 2 General (switching from Tier 4) and due to apply in person next week. Following are the details/history:

1. Came to UK under student visa (no PBS) in Oct 2008 to study MSc in a university (Highly Trusted-HEI in current list of Tier 4 sponsor)
2. Successfully completed MSc and degree awarded in Jan 2010
3. Applied for PSW in Mar 2010
4. Applied for Tier 4 Student (PBS) in Jun 2012 to study a professional course at the end of PSW
5. Two extensions for the same professional course, last one ending 30/10/2015 (next Friday)
6. Got a CoS from an A Rated sponsor this week
7. Appointment for Tier 2 General to apply in person next week

I have had continuous leave to remain after entering first time throughout my stay in the UK.

In CoS, the employer has stated that the applicant qualifies for RLMT exemption as a Tier 4 visa holder. But my query is, even if my Degree was awarded more than 5 years ago, can I still use it to qualify for RLMT exemption?

Any help to clarify this is highly appreciated.

I am afraid the answer to your question is NO

Professional courses are not classified as academic qualifications even if they are at the same level of qualification. e.g ACCA and master's. The guidance is clear on that.

So you may have to leave the country and apply as the COS issued will become an unrestricted COS.

It is a painful truth but that is it.
