SECTION 4 - BIOMETRIC RESIDENCE PERMITS wrote:If you have a current grant of leave on a Biometric Residence Permit you must provide your Biometric Residence Permit for the application to be valid and complete.
I am most likely to be self-employed. However, I would still like to be sure. This is gov web site.you may legally work, unless your ILR was revoked or cancelled after being away for more than two years……
Moreover, if you were self-employed prior to expiry of your old passport, then you have already satisfied yourself of your right to work. It's a bit silly, isn't it?’
I am not applying now, but it was 20 yrs ago. I do not need to extend as I already have LRI• apply to come to the UK
• apply to extend your visa or settle in the UK
• transfer your visa to a new passport
You don’t have to transfer your visa - you can carry both your old and new passports when travelling to or from the UK instead.’
It does not say you SHOULD… It also states:You can transfer your visa to a BRP by applying for a ‘no time limit stamp’ (NTL).
They give me an impression that it’s an option only if I wanted to…Use this form if you already have indefinite leave to remain in the UK in your passport and you now wish to transfer it to a biometric residence permit…..’
I do not meant to argue but need clarification. Thank you‘sanction will not be used where the person has existing indefinite leave to enter or remain in the UK, unless there are compelling reasons for cancelling this leave’
I've just been through this (see my thread in this forum starting "Biometric...") and from my experience, what I have been told, etc the answer is yes. I've not found a law or any similar information on the gov.uk pages, even though they are generally quite good. I did check on the right to work checklist and the position seems ambivalent, and since my new employer required the BRP before I could start, I had no choice.sushdmehta wrote:Home Office seems to be asserting the following:
1. ILR vignette in expired passport + current passport = valid to live in the UK + valid to travel to/from UK.
2. ILR vignette in expired passport + current passport = not valid to demonstrate "legal right to work" in the UK = apply for a BRP.
I am yet to come across a formal document to suggest that 2. is now a poilcy / law ..... maybe haven't searched deep enough?
