ILR after 5 years

Dear All,

I have a basic question regarding ILR eligibility.

- I was granted with HSMP visa on 12 May 2003
- I entered UK 17 Aug 2003
- My wife entered UK 01 Oct 2003
- We have been in the UK since then except short vacations and business trips abroad

- When will I (we) be eligible to apply for ILR if I ignore 28 days early application? Is it 12 May 2008 or 17 Aug 2008 or 01 Oct 2008 (when I am eligible can I apply for both myself and wife?)

17 Aug 2008 and you both can apply at the same time considering your wife entered the UK as your dependant and you meet all the other criteria like passing the life in the UK test etc.

Yes ILR clock starts when you enter the country 1st

Thanks guys I just wanted to make sure. Also, do I need to put into the form any absences (holidays, business trips, etc.) less than 3 months when I apply for ILR?

yes you would need to put all absences as well
