Withdraing FLR(0) to student Tier 4 from home country

Dear all,
Will that be legal with Immigration rule to switch from FLR(0) applied dependent applicant to go back home and apply for Tier 4 after withdrawing FLR(0) while awaiting decision from First tier Tribunal appeal. Furthermore time period spend earlier in this country will be counted to reach 10 years long stay.

Expert opinion will be highly helpful and welcomed. Thanks in advance
