Advice on Tier 4 to Tier 2 Visa application and dependants

Post by qfred » Sun Dec 13, 2015 4:12 pm

Dear Members,

I'd like to ask you few questions about the switching to from tier 4 (general student) to tier 2 (general) skilled worker.

I'm a PhD student writing up my thesis and I've been offered a job at the Uni as a post-doc, the uni will sponsor my switch. I'm not sure whether the application will be successful as my PhD studies were funded by an official agency and the requirement is to have unconditional consent from the sponsor agency to make the tier 2 application. What I have is a letter that allows me to do whatever I want for 2 years after the PhD, and my position in the university will be only for 12 months, thus the CoS will be submitted for only 12 months.
So my first question goes with regards to how likely you think my application to tier 2 will be successful? I'm worried about the wording on the text in the guidance because they don't say anything with regards to how long are you applying to stay.

The second part has to do with the fact that I have a valid tier 4 visa up until the end of 2016, so what happens if they refuse my tier 2 application, would I loose my tier 4 visa too or will they curtail my stay due to the visa switch refusal?

Also I have a dependant parter with me and I don't know whether to apply at the same time or wait until the decision for the extension has come through to apply for her switch.

Thank you very much for your advice,

Fred

Hi Fred,

Could you please let me know how this turned out for you as I am in the same circumstances: letter from my sponsor says I must return to my country on Oct 30 and my contract ends on Oct 23.

Regards,

Y.

Hello. I am in the same situation as you. I have only been giving permission to stay until my 12 month contract ends. Could you please let me know how this turned out for you?
