Spouse Visa - IHS & Financial Requirement

Post by mbist » Tue Dec 15, 2015 2:16 pm

Hi,
I will soon have PR Card after retaining right of residence after a divorce from my ex wife.
After I receive my PR Card, my new wife will soon be applying for 'Apply to join family living in UK' using VAF4A online form from India.

My questions are:
1.Will we need to pay the newly introduced healthcare charge as some where I read that we may be exempted because I have EEA route PR Card?
2.Does she still need to give her English test?
3.and still go her TB test?

Just that I have a EEA route PR, so just wondering if these 3 things are required or not?

Any help would be appreciated!

1. Yes, she has to pay it, £600.

2. Yes, English level A1

3. Yes

And, you have to meet the financial requirement of £18,600 pa.

Thanks,
I was aware of all these points, but read somewhere that some of these might be exempted as I will have a EEA route PR.
Anyone who thinks otherwise?

No, as you're divorced from your EEA national wife and are now applying for your new wife to join you under UK Immigration Rules.

In addition to Casa's post, you are not an EU citizen so cannot benefit from EEA route rules and only the UK immigration rules will apply once you have permanent residence granted.

We are assuming that you married your new wife after the decree absolute was granted from your EU wife.

Meeting Financial Req

Post by mbist » Tue Jan 05, 2016 4:28 pm

Hi,
Apologies for posting a question based on my situation but it falls under the same Subject.

I will soon have PR Card (well hopefully) and then will apply for spouse visa for my wife. I am on 40k permanent job (same in last 6 months). As per court order from my earlier divorce, I have been paying my ex-wife £1000 per month which will increase to £1200 soon but only until May 2017.

1. Should I be mentioning this in the Appendix 2 form, 1.28 - Is your sponsor responsible for supporting anyone financially? (as they might see regular outgoing in my bank statement).

2. Will I still meet the financial requirement?

I was checking this and haven't come across similar situation in this forum, so some response will be greatly appreciated.

Thanks.

To meet the financial requirement, HO is interested in your Gross salary before tax and deductions.

Thanks,
So do you think it'll be fine and do I mention outgoing in 1.28?

Hi,
My wife will be applying for spouse visa from N. Delhi soon.

If I am the sponsor and providing my financial details, does she need to provide the following at all ? :

1.Her employment contract
2.Her recent payslips
3.Letter from her employer
4.6 months Bank statements showing salary

Thanks in advance!

Yes, you need to declare the spouse maintenance payment.

Thanks for the rely Casa.

Bit confused. You mean I need to provide my financial details to support her, but she doesn't need to provide her employment details at all?

I will be providing my details of employment of course.

Only you as the sponsor are required to provide and meet the financial requirement.

Hello,
Quick q's regarding spouse visa application:

1. Does the TB test need to be 'no older than 1 week' before application as stated by few members? Or does '6 month validity' means that can be used anytime before it expires.

2. Sponsors Passport copies: Does these really need to be certified by solicitor? Some people do it, but I'v heard that this is not required and a waste of money. Please confirm.

Thanks in advance.

The pages of your passport should be certified, but I believe that the Post Office also offer this service.

Thanks Casa,

I finally got my PR card today :) Few queries below:

1.In the letter it says that I need to have comprehensive sickness insurance? what does that mean? I have a private medical insurance from my work, so that should be fine right?

2.Also, the PR Card says that 'family member of EU member' although I got PR after retaining right of residence after divorce. Hope that is not an issue w.r.t. sponsoring my Non EEA spouse to come and settle with me in UK, which I am planning v.soon.

Cheers!
