ILR due 4 days after company takeover

Post by davidolowoleru » Wed Dec 23, 2015 11:53 am

Hello Everyone, I really need your advice on this.
My company is due to be taken over 4 days before my ILR earliest possible application date. I have been told by HR that TUPE does not apply and the best scenario is that I wait for about a month while they reapply for their sponsorship certificate under some new category. I really don't want to wait due to fear of redundancy.
As my application supporting documents only need to be less than a month old, what are my options and chance?

What if the caseworker checks whether your sponsor holds a current license or not? You okay risking the hefty application fee ... and (perhaps) also be accused of deception?

Are you sure about 4 days? Have you done the calculation right? May be you can add some details here and some senior member can check if you have done the calculation right and you can't apply earlier than that?
I am not an immigration adviser...All IMHO.

Thanks for this. I can't be specific on dates for legal reason.

The ILR due date I chose is 28 days to the 5th anniversary of my visa stamp date (I came into the UK 16 days after the visa stamp date).

What is the window between the "earliest date to apply for ILR" as calculated by you and the "latest date to apply for ILR" (28 days following expiry of current leave)?

About 4 months, But the risk is more about the fear of redundancy. I spoke with HR and they said the takeover will not affect my application in anyway.
