Long residence ILR - Spouse status

Post by malik84 » Sun Dec 27, 2015 9:35 pm

Hi Gurus
Can you please help me with this query!
I will be eligible to apply for ILR on 10years (LR) route IA, I came to UK in May 2006; my wife joined me after 7 months in March 2007. our current Tier 2 visas are valid until June 2018. If I get ILR on long residence basis in 2016, do my wife definitely needs to switch to FLR (M) or she can continue on her Tier2 dependant visa until she completes her own 10 years requirement.
I understand that my dependant cannot get ILR on her T2 dependent visa, after my ILR on Long residence basis; but I don't want to switch her visa to FLR(M), will she still be lawful resident (on T2 dependant visa) after I get 10year ILR, i.e from May 2016 to March 2017, until the time she is eligible for her own ILR on 10 year basis
Thanks a lot in advance

She should be ok provided that HO don't curtail her Tier 2 Dep visa (some people have had this problem) or travels as if she travels, she risk refusal of entry when she returns.
