28 days rule

Hi Guys,

I am on Tier1 general visa and my 5 years stay will complete on 3rd March 2016. According to new 3 years visa rule my new visa expiry date is March 2017.

According to ILR guide lines i can only apply 28 days prior to my visa expiry date but my 5 years are completing on March 2016. Because of this 28 days rule do i need to wait one more year?

In your case if your 5 year qualifying period for ILR ends on 3rd March, 2016 then you can apply within 28 days before it. You don't have to wait for your current visa to end.

ashafqat, when were you granted leave initially and when did you enter the UK?

If you entered UK within three months of your visa stamp date then you just add 4 year 11 months and 2 days to the visa stamp date.

You are eligible to apply for ILR 28 days before your 5th year completion. So, if your initial tier 1 visa was granted 3rd March 2011, then you can apply 28 days before 3rd March 2016 and it really does not matter when your current visa expires (after the 3rd March 2016 that is). However, if you prefer, you can wait till you get close to the end of your current visa but that doesn’t make much sense as generally you want to get your ILR done as soon as possible.

When I applied for ILR I still had about 4 months left on my visa, and I got it, no question asked.

Only thing you have to be concerned about here is when you entered UK? If that is within 3 months of the visa's starting date than you are cool.

Thanks guys for your help. I got my Tier 1 visa on April 2009. I first time entered on October 2009 just for few days but i fully moved in UK on 3rd March 2011. Got my 2 years extension on 2012 and on 29th March 2014 i got 3 years extension expiring on 29th March 2017

As you explained If my duration starts from 3rd March 2011 then my 5 years will complete on 3rd March 2016

If absences are <180 days per 12 month period then from 28 days before October 2014.

i been granted Tier 1 General on 28 April 2011 to 28 April 2013 while i was in the UK
i applied for extension and Granted 12 April 2013 to 12 April 2016.
Now what i understand is that i can apply for My ILR any time after 31 March 2016 . is that Correct

but when i gone through policy guidance

"The specified continuous period is counted backwards from the date of the ILR application. For example, if the date of application is 11 November 2012, the consecutive periods would be as follows:

Year 1 11 November 2012 to 12 November 2011
Year 2 11 November 2011 to 12 November 2010
Year 3 11 November 2010 to 12 November 2009
Year 4 11 November 2009 to 12 November 2008
Year 5 11 November 2008 to 12 November 2007"

than how my 5th year will be completed if i apply for ILR on 5 April 2016
my year5 5 April 2012 to 6 April 2011

and i don't have Tier 1 General for the 22 day of April

i am confusing my self with the policy guidance

one more thing about police FPN for trafic lights where i received Points and Fine any problem for them. need to declare them on form or any guidance

You can apply on the 31/03/2016 as you get a 28 day relaxation

sorry for crashing into this thread, but i have a similar quesiton...

what is rule if current visa expires 4 days BEFORE completion of 5 years.... but it is still well within 28days ..

for ex- my current visa would expire on 16 apr 15 and i will complete 5 years on 20th apr 15
can i apply 28 days before 20 Apr 15 which is 23 March 2015

yes you can apply before 28 days of 20th apr 15 if you arrived in the uk within three months of ur visa stamp.

Hi, I am applying for my ILR next year. I am working as a Limited Company Director. I dont take dividednds on Monthly basis. Instead of Monthly payments i pay myself quarterly. Is it all right to show 12 monthly pay slips and 3 Dividend vouchers?

Yes its fine to show 12 months payslips and 3 Dividend vouchers.
be remember to submit following documents as well if you are claiming dividend Income as limited company director.
Working in his/her Own Limited Company Structure
1-Certified Accountant's Income Certificate confirming the exact claiming amount
2-Dividend Certificates
3-Business Bank Statements
4-Personal Bank Statements
5-Company Annual Accounting documents
6-Business Invoices

Hi Friends,

A quick question, I am on Tier 1 visa and my wife has a dependent visa. In March 2016, we are planning to apply for ILR. A couple of months back, police stopped my wife for using her Mobile phone while driving and they advised her to take a Driver offender course "What's Driving Us?". No point on her license.

Do we need to mention this in ILR form?

Below is what mentioned in SET(0)

"Note: You must give details of all criminal convictions, including spent convictions. This includes convictions for road traf c offences, including drink-driving offences, but not fixed penalty notices (such as speeding or parking tickets)."

6.1 When did you (the main applicant) first enter the UK? This refers to the date of your first
entry into the UK at the beginning of the period of stay on which this application is based.

I first entered in the UK on 9th September 2009, but I left after few days. I returned back permanently on 4th March 2011 and my 5 years will complete on 3rd March 2016.

What date do I need to write in question 6.1, 9th Sept 2009 or 4th March 2011?

Secondly, Do I need to provide out of the UK dates and copies of exit and entry stamps for my dependent applicants?

Last, Do a single SET(0) covers main applicant and all dependents or like Tier 1 I need to fill separate form for each dependent?
