Traffic offences. Help please

Post by uninsured » Wed Oct 24, 2007 7:23 pm

I've been sentenced for two offenses:
-driving while uninsured
-driving without a valid driving license.

Paid £240 (fines + court cost)

I already got my ILR (through marriage)last August. And wish to apply for Citizenship next August. But now because of the above I have to wait for 2 years from the date of sentences.
Is there any chance for my application to succeed if I applied before the clear period expires?

Im in pretty much the same situation as ''uninsured''..(no licence+no insurance).

Its been over a year (not 2 years though) since the 'conviction' and ive had ilr>1year i.e. i qualify for naturalisation...is it worth applying?

I mean im sure i can demonstrate im of 'good character' im not evil.
would academic/professional record help?
In fact i can justify my conviction in terms of extenuating circumstances..

Can anyone share some knowledge or relevant experience please??

Did you get your traffic offences after you received ILR.

Yes I got the offences 3 months after I got my ILR.
Starting Jan 2008 the clear period is not valid any longer. Now I have to wait for 5 years after the fine.

When you applied for ILR did you inform them you were awaitng a court proceeding, sounds like you did not.

I would wait the two years clear period and then apply, as HO do mention they take no insurance as a serious offence.

After the clear period I highly doubt they would refuse you.

Act least you have ILR and could even wait 5yrs and not mention anything at all.

It's important to realise they aren't just simple traffic offences like speeding or illegal parking. Driving without a license and driving without insurance are serious crimes in the UK.
In a few years time we'll look back on immigration control like we look back on American prohibition in the thirties - futile and counter-productive.

Starting from January 2008 the clear period rule has been eliminated.

what I notice is that the people who shouldn't be driving are always getting caught. Maybe you should think why your license was suspended and realize you don't think smartly when you are drunk and avoid getting drunk. Just incredible.

It doesn't matter why you were driving. There's no excuse for driving without a license and insurance!

Looks like you`ll have to wait until the conviction is spent before you can apply for naturalisation....

Sheesh, you are sensitive. As I wasn't quoting you, you shouldn't be so touchy. It was a general statement. And yes it is a pearl of wisdom.

Hi,

Did you get your application successful?

I have 3 penalty points in court back in Dec 2007 as i was driving on international license, not sure if I should wait till Dec 2010 or I can apply now?

Thanks.
