Quick question regarding staying out of UK on a tier 2 visa

Post by kumar114 » Sat Jan 16, 2016 6:01 am

Hi,
I am on a Tier 2 right now.
Currently out of UK on a holiday.
Its been a bit more than 1 month now since I am out of UK.
Will it affect my VISA extension because I am out of UK for more than 30 days?

Kind Regards
Kumar

No. As long you have taken annual leave and not absconding from work without informing employer, then it should be fine.
My advice is based on personal research/experience, so pls check relevant UKVI sources.

Where are you reading that this might be an issue?
I do not give immigration advice. I refer you to Immigration Rules, guidance, other online content and to your sponsor.

Thanks @srsw. I just come to a post where it says that it applies only if I apply for ILR.
Is that correct. How long can I stay out of UK in a year. I am in Tier 2. I am extending on my Tier 2 VISA next year.

Just wanted to make 100% make sure..

Kind Regards
Rayesh

The absence limit for ILR is no more than 180 days in any 12 month cycle.

There is no rule that you cannot be out of the UK for more than 30 days, provided you have approved leave from your employer sponsor and that you are still employed and paid.
