Benefits after ILR

Post by SYED.ZAIDI » Wed Jan 20, 2016 12:40 am

Hi
just a quick question ... is it save for me and my wife to start claiming any potential benefits as we both going to apply citizenship and British passport later this year.
our status is .... wife got ILR in Sept 2015 and i got my ILR in Dec 2015. our children age 8 years and 1 year have registered as british nationals in Dec 2015. wife stop working from Oct 2015 to look after little one. I'm working as full time.
I'm asking this question as i heard from one of well know lawyer that if you can avoid claiming benefits before naturalization then better if you avoid.

so please advise. many thanks Syed

The 'well known' lawyer is wrong. Perhaps he doesn't specialise in Immigration law.

You and your wife are no longer under Immigration control and are free to claim whatever benefits you are entitled to, without restriction. It won't have any negative affect on your BC applications. Here's a link to help you calculate which benefits you can claim. For calculation purposes, choose 'British' for you both in the options.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.
