TIER2 G Supplementary employment

Hi All,
As per TIER2 General Policy document states that
“You do not need to inform us of any supplementary employment, as long as it is:
• in either a job which is included on the Shortage Occupation List in Appendix K of the Immigration Rules or a job in the same profession and at the same professional level as the work for which your Certificate of Sponsorship was assigned; and
• no more than 20 hours per week; and
• outside of the normal working hours for which your Certificate of Sponsorship was assigned.
In addition, you must continue to work for your sponsor in the job recorded on your Certificate of Sponsorship.

I’m intending to do 20 hours per week work but my question is;
• Can I set up a limited company so I can look for work and offer my services to clients?
• Client will only pay to a company not your personal account.
• How can I pay tax? HMRC,?
Any thoughts/advise will be highly appreciated.

No, you cannot set up a limited company on a Tier 2 General.

Yes because you will be in breach of your visa conditions, regardless of which route you apply for ILR. Tier 2 General is not what the Tier 1 General was, the rules are very different and far more strict for Tier 2 General.

Hi CR001,
Thanks for your helpful response, I'm worried now.
Actually I set up a company just to have a name on companies house. Company never done any trading or business. and it last only 55day. Now I issued a termination notice of director.

in theory, director remained only for one day.

should I still seek professional help and will it still be violation of TIER2 G visa rules?

will it apply same on dependent of TIER2 G?

You are in a technical breach of your Tier 2 visa conditions HOWEVER if you have never traded the company and you are now resigning from the company as director then there is an argument you have never been self employed.
HO checks rarely run to Company House searches on individuals.... And if you have never been paid or registered with HMRC then the whole thing will not show up....
I would doubt very much it will cause an issue going forward.
