ILR due in MARCh 2016

Hi ,

My ILR is due in March 2016. I am on Tier 1 General visa and my firs Visa was granted on 26 March 2011. My Question is related to Previous earnings. In My first time i applied through self employment and employment for the period of Feburary 2010 to January 2011. I showed income of 25500 from employment and 9900 from self employment Total=35400. Now when i checked the self assessment details because it runs April to March so it is showing 26980 from employment and 8870 from self assessment Total= 35850. I needed 35000 to qualify for the points. Can Someone please advise if there is any issue here as the figure for self assessment is bit different than shown to Home office

IMHO, income records as appearing with HMRC and as decalred to HO could vary for various reasons, which incule the following:

1. Non taxable components in salary: Salary sacrifice for Pension, insurance etc.
2. Mismatch due to periods other than official HMRC tax period.( change in salary, divident etc.)

As long as the variations are not huge and are justifiable it should be OK.

HI Rahul,

Appreciate your response. i am not sure how home office work on it. what i have shown was period from feburary 2010 to jaunary 2011 which is 12 months Employment 25500 + 9971 Net profit from self assessment Total = 35471. HMRC record is showing for april 2010 to march 2011 Employment 27050 + 8841 self employment Total = 35891 exactly.

If home office will consider 25500 from employment and 8841 from self employment than it will calculate as 34431 which is below 35000.

Can you please advise on this.

Why your SA moved from 9971 to 8841 ? More expenses over the year or accounting error.

The only problem with amendment is it takes 3-6 months to update with hmrc?

Correct, however that will proof that you have found a mistake and your intentions were good to make the changes.

If you hold the information while you the what is right and wrong that will be worry some.

5 years income Tier 1 General to ILR

Hi,

Can any one advise when HO asking for last 5 years SA302 for Tier 1 General. Is it necessary that you meet the threshold in all the 5 years or just the years of Application. For example if the threshold was 35,000 at the time of First Application that Applicant has to earn 35,000 in all the 5 year? or its just the last 12 months at the time of Application.

yes you need to have same amount of earning which were on your first application unless you have complete PHD etc to increase more points.

also you need to have SA of last 5 years if you were ever self employed or director of Ltd company and calming any dividends

Well you do not need to be earning the same amount for full 5 years . But it must match the years your initial and extension applications . The amount claimed for points should be the same amount which was declared to HMRC for initial and extension application .
