please Help me Regarding my ILR application.
I was last granted leave to remain in the UK as a Tier 1 (General) Migrant on 11th May 2011 until 9th May 2013.
I made an in-time extension application on 17th April 2013 which was refused by Sheffield office on 21st May 2013.
We filed an in-time appeal form with the First-tier Tribunal on 31st May 2013 and my hearing was heard on 18th February 2014 at IAC Birmingham. The appeal was dismissed by promulgation dated 17th March 2014.
We filed an in-time permission application to appeal to the Upper Tribunal with the First-tier Tribunal on 26th March 2014, which was refused by a decision of 28th April 2014 that was posted to us on 30th April 2014.
Finally, we filed an in-time permission application to appeal to the Upper Tribunal with the Upper Tribunal on 9th May 2014, which was refused by a decision of 27th May 2014 that was posted to us on 28th May 2014.
I had submit a fresh extension application is made within the allowed 28 day period as paragraph 245CA(g) states “any period of overstaying for a period of 28 days or less will be disregarded.” finally, I grant my 3 years extension until June 2017.
My question is: Can I apply for my ILR now? or wait until 2017 my visa expired? I though I could apply ILR this year, because my first grant is in May 2011, and i did fresh application within 28 days, which can be disregarded. Am I right?
