I am trying to get information for a friend. Her cousin is married to an Algerian national who is currently living in the UK on a spouse visa (since July 2014). However, they are considering separating but are worried about the repercussions on the husband's visa status. They have a 3 year old child who has a close relationship with both parents, but would live with her mother, who is a British citizen. The husband works, but earns less than 1000 per month. However, he would be able to adequately maintain himself and contribute to his daughter's upbringing. Is there an option available to him to remain in the UK, or would he have to earn £18600 plus to qualify? Please can anyone help as this worry is adding to the stress they are already under.
