Tier 2 Extension

Hi All,

I would really appreciate your help.

I am applying for my Tier 2 extension this month, for my required code the experienced salary requirement is £ 28,600 which as per my knowledge is for 39 hours. Currently I am doing 37.5 hours and we have agreed to reduce my hours to 35 hours per week in new contract as they are no willing to increase salary to £28,600. So I assume I need £25,662 ( 14.10 X 35 X 52 ). please correct me if I am wrong?

My employer agreed to increase salary to £ 23,000 plus guaranteed bonus of £ 3,000 as I receive extra payments from them as bonus few times a year. so my earning will be £ 26,000.

Please advice if my understanding is correct and I can apply on these basis.

So I assume I need £25,662 ( 14.10 X 35 X 52 ). please correct me if I am wrong?
If I'm not wrong, it should be 28600/39 * 35 which gives you £25,666.67 for 35hrs a week

Thank you for your reply, yes it should be £25,666.67 but my employer will be showing £ 26k so its fine.
My main concern was that since I will reduce my hours from 37.5 to 35 hours it will be fine? and can I prorated my salary like I mentioned to match requirement or I must have to earn £28,600 no matter I do 35 hours or 39? also for guaranteed bonus do we need to mention the date when it will be paid?

immigration health Surcharge - not paid enough

I am applying for 1 year extension for my Tier 2 , I paid £200 IHS fee is that right or do I need to pay £600 and they will refund later? since I mentioned the dates for one year extension in IHS application system asked me to pay £200 .

If you are only applying for a 1 year extension (i.e. CoS issued for 1 year) then £200 is correct.

Thanks yes I am applying for only one year visa, I was concern because from some threads I read the members were facing problem where they paid less and then home office asked to pay extra payment and then refund once visa issued.

I will appreciate if you can look into my other thread for which I am waiting for response on Tier 2 forum, I don't really like to open too many threads sorry for that

when IHS was first introduced, it was charging everyone full amount. Since then, it has improved and only charging what is necessary

Yes, you can prorate you salary if your contracted to work 35hrs a week , so 26k for 35hrs/wk is acceptable.
No need to mention the date of bonus payment

Hi , I need experts advice as I am worried from above posts now, My employer issued the COS for extension stating that I will work 35 hours and my salary is £23,000 plus 3,000 guaranteed bonus so total of £26,000. the requirement as per my SOC code was £28,600 for 39 hours. On my COS my employer mentioned as per below:


1) Gross salary including any allowance and guaranteed bonuses; HR entered '' 26,000''
2) Gross allowance and guaranteed bonus included in the above figure: 3000
3) Summary of allowance and guaranteed bonuses:HR entered ' Guaranteed bonus £3000

is that fine?

They don't look too closely at the previous employment conditions on your COS at the point of issue. So unlikely to be an issue.
BUT a visiting compliance officer will do so....
What you are describing sounds like a deliberate case of hour reduction to meet the salary criteria.
That will lead to problems after the company gets a visit. It is a well worn path to licence revocation because it is a deliberate misrepresentation on the COS and leads straight to revocation under dishonesty.
Why is your sponsor not willing to meet the experienced rate of pay?

Thankyou for your reply,

The reduction in hours is only 30 minutes per day. The reason behind is that me and my employer has agreed to extend the break from half an hour to one hour, can't that be justified? We have drafted new contract as well stating the contracted hours of 35 and one hour break.

Ok thanks and I am sorry if I have done something wrong.

So the reason for change of hours is not right? I should still show the working hours as £37.5?
If I speak to my employer and they are happy to increase salary as well as amending the working hours what should they/I do as COS is already assigned. Please suggest me what action can be taken?

To give you overview I am working in a small company, we are only three employees. Two of us are under Tier 2 General so its no a big company, what about if my employer declare that all of us have one hour break from now instead of half an hour? If that's not the option then how can they amend they salary and working hours on assigned COS?

Need one more advice from you please. At my first application on COS I was working 37.5 hours , now I work 35 hours a week can it be a problem?
