URGENT 3 Months Short of ILR for 10 Years long residancy

Hello Everyone,

I have 3 months left for 10 years to finish but my FLR FP file has been refused with NO in country appeal. So what should I do next?
I am in my 28 days period to apply and also the HOME OFFICE holding my passport since my TIER 1 Entrepreneur application refusal and I do not have driving licence so to give life in uk test what should I do to short out this situation?


all expert advice welcome.

You can request your driving licence back to do the LIUK test. You may apply for FLR(LR) within 28 days of that decision and hope for a grant.

would be kind enough to shed some light on flr LR ,

there are so many flr's , and when csn one apply that and how it differes from the common flr Fp ??

Generally, FLR(LR) is for those who meet the requirements for SET(LR) but for KoLL or perhaps fail suitability.

Amber, does FLR(LR) stand a chance when the OP is short of LR by 3 months? :?

@montudipal007 Has your driving licence been retained, or have you never been issued with one?

It depends, if by the time the application is processed, the Applicant has reached 10 years, but for 28 days, the application should be considered.

Hello

Sorry for the late reply but I am in the situation is that I had suggestion from my friend is that I need to apply for SET (O) to complete 10 years then apply for set LR.

BUT

there is also another problem is that my passport is with the home office and I DO NOT have Driving licence what can I do ? to resolve this issue and give my life in uk test as well.
early replies needed please.

Thanks for replying i was asking honest expert advice on this so if can help me on this issue.
That I have 3 months left for 10 years and my flr fp file has been refuse so what can i do next to finish the time and about the passport issue as well i need help

Set(O) is an application for ILR based on 5 years residence as a Points Based Migrant (Tier 1, Tier 2). Don't see how you think this might be relevant to 'buy you time'.

I have spoken to a couple of solicitors specifically about this point. They gave totally different answers.
One of them said that the application shall be successful if by the time the application is processed, the Applicant has reached 10 years. But others said, even if the applicant has reached 10 years by the time the application is processed, the application will still be refused, as the Caseworker would consider the date of application as effective date of application and not the processing date.
