Hi I need some help regarding my ILR application . I went for premium service on 20th January 2016 based on 10 year long residency rule . HO gave me tax form which I had to fill out that during my 10 years if I was self employed and if yes which years and did I submit my tax returns for those years . After waiting for 5 years they said to me they need to do further checks and wait for decision . Till today I haven't got any reply . My visa status is came to uk In Jan 2006 as student then 2008 psw then 2011 -13 hsmp 2013 till Feb 2016 2nd hsmp tier 1 . Also when I got hsmp in 2010 I showed 9k through self emplynt and 26 k through retail job and 2013 I shows 12 k through self employment . Hrmc has no record of my self employment . I submitted my amended tax returns for 2010-11 through post 2011-12 and 2012-13 online using some software . I contacted hrmc they received all my updated tax returns . And now I had to pay nearly 9000 tax. I set up a direct debit of 250 pounds a month first instalment is already gone on 4rth Feb . My questions are--- shall I pay all this tax in one go or is it fine to pay in instalments.? Also as I was reading on this form can HO still refuse my visa as I did all this amended tax return work after attending premium service . Please advise also if they refuse my visa will I get appeal right or not

Hi I need some regarding my ILR application first of all my visa history came to uk in Jan 2006 on student visa 2009-11 psw 2011-13 hsmp 2013-16 hsmp 2nd extension . applied for ILR based on 10 year rule last month .went through premium service HO gave me a form to fill out if I was self employed in last 10 years of yes give details and if I submitted my tax returns . Waited for 5 hours and they gave me a letter saying they need to do further checks and wait for their decision . Till today still waiting for their decision . After consulting with solicitors I contacted hrmc and find out that they have no tax returns for my hsmp visas I mean 2010-11 during my first hsmp I showed 9k through limited company and then 2012-13 12k though self employment but other limited company . Now both companies are dissolved. I contacted accountant and amended my 2010-11 tax return through post and 11-12 and 2012-13 accountant did online .i contacted hrmc again and they said they got all 3 years tax returns how ever they only processed online once so far and for post one they said by March end they will do it. And we agreed for a direct debit of 250 pounds a month. I already paid my first direct debit on 4rth February . My questions are- can home office still refuse my visa as I amended my tax returns after attending premium service . Also my tax will benearly 9k for both 12k and 9k self employment earnings as other earning were from job for 35 k rule and I paid tax for them . Shall I pay this 9k in one go or continue paying 250 a month , also if they refuse my visa can I appeal . Please advise

Hi Mate

Sorry to hear that your ILR decision is pending. But why did not you submit your tax return on time or did you submit but did not pay even a penny to HMRC . I think you should have amended your tax return before applying ILR. 9K+12K= 21K and tax is £9000 how come? .

This forum has been overwhelmed with tax 'discrepancy' issues and as we have no tax specialists active here, we can only advise on purely immigration matters. Search for a tax forum.

Very hard to read this explanation but you seem to ask of the chances for/of an appeal.

There have been a spate of members in a similar situation recently.

Whether that is due to a batch of poorly inexperienced applicants &/or due to the activities of poor advisors/accountants I cannot say.
It may be due in part to increased vigilance (& collaboration) on the part of HO (& their HMRC partners) due to prevailing political conditions.

It has not turned out well for some of these cases.
However it appears that in some such cases there is the possibility of AR &/or JR (but not for an 'appeal' as such).

Note this is not a tax forum.
There are no tax consultants here.

Kindly focus discussions & advice on immigration-related matters, regulations & procedures.
