ILR for PBS dependant

Post by Aarav2015 » Mon Feb 22, 2016 8:51 pm

Hello All,

I'm a ILR holder and my route is tier 2 ICT.

My wife came to UK on Dec 2013 through PBS dependant. I extended her PBS dependant visa recently till Jan Feb 2019. She will become eligible for ILR by Jan 2019.

My question is whether the continuous residence rule of <180 days per year for the past five years is applicable for PBS dependant becoming ILR? If this is not applicable, please advice on what continuous residence rule does apply?

Can anyone please clarify

Thanks

No, it is not applicable to dependents however, absences should be limited and for good reason, i.e. she cannot 'live' in home country for most of the year and only visit the UK for short periods.
