Submitting form EEA3 - questions about employment history

My husband is submitting form EEA3 for PR (he's a Dutch National). See this thread; http://www.immigrationboards.com/eea-ro ... 03276.html

Sorry to start a new thread but thought these questions would get lost in the old thread :oops:.

I just have a few questions regarding the employment requirements.

1) He was working through his own Ltd Company (he was a Director) for some of the past 5 years so he paid himself a low salary and took dividends. Do the HO look at how much someone earns or do they only require proof that they were employed? Also, I assume that as a Director of his own Ltd Company this is not required to be listed as "self employment" as he was technically employed by his own company?

2) Form EEA3 says he needs to supply; "employers letter, P60 and most recent wage slips". How strict are they on these as we cannot find a P60 so would need to supply a P45 instead. Also, he doesn't have employers letters from each company he worked at. Can he submit his self-assessment tax return instead (even though this is listed under "self employment")? Basically how strict are they on what evidence is supplied? Do they want to see continuous proof of employment or amount earned?

3) He had a few months off between jobs whilst looking for work. Does he need to provide proof of self sufficiency? Also he did not have Comprehensive Sickness Insurance as he was unaware he needed it as a Dutch National.

4) Finally, what happens if his application is rejected? Can he reapply as many times as he likes?

Have been advised by other members on here that he can use form EEA3 which is much less intrusive and HO cannot reject an application made on this form.

No he doesn't, although this is the form that UKVI would prefer people to use, they cannot reject an application made on an old form (EEA3 was the form used before they rolled a bunch of them into one); similarly they cannot reject an application made on NO form providing the correct information, evidence and payment is supplied.

You can apply as many times as you want, but you obviously lose the fee each time.
