ILR for British spouse and children to live in India?

Post by OL7MAX » Fri Nov 09, 2007 12:22 pm

I have applied for ILR in the UK and am hoping to get that in due course. But, I may choose to not actually live in the UK and may move my family to India.

I'm on an Indian passport and my wife and children are British by birth. Any idea on how they can live legally in India without losing their British passports? Any long term residency they can get in India as a result of my being Indian? And how does the process work in practice (whom do I bribe etc)?

Have a look here, might be what you're looking for:

It seems your British citizen children are eligible for overseas citizenship of India (OCI).
In a few years time we'll look back on immigration control like we look back on American prohibition in the thirties - futile and counter-productive.

Thanks for your reply. If there is a 2002 cut off date my kids won't all qualify :(

Where do you get the 2002 cut off date from?

A PIO card is an alternative to OCI.

I can't find the link now, Jaj. Looking at the Indian Embassy site FAQ again it appears I may be mistaken on the 2002 date. If that's the case then all my children are eligible for OCI and my wife is eligible for PIO.

I'm telling ya, she married me only for my passport! ;)
